“Enova decided to keep flouting the law after it was caught taking advantage of its customers, and violated a law enforcement order.”
That is CFPB Director Rohit Chopra describing a repeat offender. CashNetUSA is not a storefront lender you can walk into. It is an online-only operation under Enova International, and the regulatory record shows the company was ordered to stop certain practices, then did them again. This page explains how the products work, what the federal actions actually changed, and the practical steps that matter once the automatic withdrawals start causing problems.
Who CashNetUSA Is
CashNetUSA is operated by Enova International, a publicly traded company (NYSE: ENVA) headquartered in Chicago. There are no storefronts. Everything runs online: lines of credit and installment loans with APRs that commonly range from roughly 100% to 325%+ depending on the state.
NetCredit is a sister brand under the same parent. Both companies were covered by the same CFPB consent orders. If you have accounts with both, the rights and limitations described here apply equally.
Being online-only changes the risk profile in three concrete ways. There is no physical branch where you can demand an Extended Payment Plan in person. Collection activity can move faster because the company already has direct ACH access from day one. And defaults frequently land first in specialty credit bureaus that most consumers never check.
The Deceptive Extension Trap
This mechanism is specific enough that the CFPB called it out by name.
A borrower who cannot make a full payment requests an extension. CashNetUSA approves it. During the extension period the borrower, trying to show good faith, sends a partial payment. The system treats that partial payment as a payment attempt that voids the extension. The account immediately defaults — even though the borrower believed they were complying with the new arrangement.
⚠ The practical defense: once an extension is approved, do not send any money until the extension period ends or until you can pay the full amount required under the extension terms. If you are unsure, get written confirmation from CashNetUSA that a partial payment will not cancel the extension.
The Two CFPB Actions
2019 Action ($3.2 million)
The CFPB found that Enova made unauthorized ACH debits and failed to honor promised extensions. The company paid a $3.2 million civil penalty and was ordered to stop the practices.
2023 Action ($15 million + 7-year ban)
Enova was hit again on the same core issues — unauthorized debits and deceptive extension practices — affecting roughly 111,000 borrowers. Director Chopra's language about “keep flouting the law” came from this case. The company paid $15 million and accepted a seven-year ban on originating single-payment payday loans, running through 2030.
The ban is narrow. It covers single-payment payday loans only. Installment loans and lines of credit remain fully operational. If your current CashNetUSA product is a line of credit or an installment loan, the interest, draw fees, and repayment terms continue under the existing contract. The ban does not freeze or reduce those balances.
September 2025 — Order Closed
The CFPB later confirmed that Enova had completed the required compliance steps and closed the order. “Closed” means the company satisfied the administrative requirements of that particular order. It does not mean the underlying conduct was declared legal, and it does not erase individual consumer rights to dispute debts or file new complaints.
Credit Reporting: Beyond the Big Three
CashNetUSA and many other short-term online lenders report activity to specialty credit bureaus that most people never look at. Two of the most important are Clarity Services (an Experian subsidiary) and DataX (an Equifax subsidiary).
The practical result is that your regular Experian, Equifax, and TransUnion reports can look clean while Clarity and DataX still carry the default flag. Other payday and short-term lenders that pull those specialty reports will see the problem and often deny new applications.
Under the Fair Credit Reporting Act you have the same rights with specialty bureaus that you have with the big three. You can request your reports directly from Clarity Services and DataX and dispute inaccurate information. You can also pull your standard reports at annualcreditreport.com. Checking the specialty bureaus is frequently the only way to see why a new short-term loan application keeps getting declined.
Data Breach — Check If You're Covered
In November 2023 an unauthorized party used personal information to access some CashNetUSA accounts. Enova later resolved related claims through a class-action settlement that created a $10 million fund.
If you received a security notice from CashNetUSA in 2023, or if you were an active customer around that time, it is worth checking current settlement eligibility. Search “Enova International CashNetUSA data breach settlement” or contact class counsel. Lawhelp.org can point you to free or low-cost help if the process feels opaque.
What Happens If You Default
The first 90 days are internal. Expect repeated ACH attempts and high call volume. Between roughly 90 and 180 days the company or its assigned collectors often begin offering settlements in the 50–75% range. After 180 days the account is typically charged off and either assigned or sold.
Three names appear with some frequency:
- January Technologies (January.com) — a digital collection platform. Borrowers receive validation notices directing them to the January website. Treat any communication from January as a formal collection contact and send a debt-validation letter before paying.
- UHG I LLC — a debt buyer that has filed actual lawsuits. If UHG I appears on court papers, treat it as a real case that requires a timely response, not a bluff.
- Sequium Asset Solutions — another servicing collector that surfaces on some accounts.
Scam collectors also use the CashNetUSA name. Washington's Department of Financial Institutions has issued alerts about fake “Collections and Legal Department” emails demanding payment for “lawsuit” and “court restitution.” Real collectors from CashNetUSA or January Technologies do not threaten arrest or criminal prosecution. Any message that does should be reported to the FTC and the CFPB. The moment any collector makes contact, send a debt-validation letter before paying anything.
Settlement Reality
| Time window | Typical approach | Common range |
|---|---|---|
| 0–90 days | Internal recovery focused on full payment | Almost no principal discounts |
| 90–180 days | Pre-charge-off settlement offers | Often 50–75% of balance |
| 180+ days (sold) | Third-party debt buyer negotiations | Commonly 30–50% lump sum |
Lump-sum payments produce the deepest discounts. Installment settlements are available but usually require a higher percentage of the balance, and missing a payment often voids the entire agreement. If the account has already moved to UHG I LLC, the incentive to settle before a lawsuit is filed is stronger than with purely phone-and-letter collectors. Sample language lives in the debt-settlement guide and the settlement-offer letter template.
EPP: Must Ask, Won't Offer
In states that mandate Extended Payment Plans, CashNetUSA is required to offer them. Because there are no storefronts, the request has to be made by phone or, better, in writing through the account dashboard or email. Company guidance says to contact them at least two business days before the payment date.
Get the request in writing and keep the confirmation. Screenshot the dashboard message or save the email. Online lenders sometimes claim they never received a verbal request; a written record closes that gap. Do not confuse a partial payment with an EPP request — the partial payment can trigger the extension trap described earlier. Full state-by-state steps are in the Extended Payment Plan guide.
Frequently Asked Questions
Does the CFPB action against CashNetUSA also cover my NetCredit loan?
Yes. Both brands sit under Enova and were covered by the 2019 and 2023 consent orders. See our NetCredit page for the installment-specific details.
How can an approved extension get canceled without warning?
If you send a partial payment during the extension period, the system can treat it as a payment attempt that voids the extension. Do not send money until you can pay the full amount required under the extension or until you have written confirmation that partial payments are allowed.
How does a default affect my credit if nothing shows on Experian, Equifax, or TransUnion?
CashNetUSA frequently reports to specialty bureaus such as Clarity Services and DataX. Those flags can block future short-term credit even when the big-three reports look clean. Request your reports directly from those bureaus and dispute errors.
Who is January Technologies?
A digital collection platform that handles some defaulted CashNetUSA accounts. Validate the debt in writing before making any payment.
Was I affected by the 2023 data breach?
If you received a notice or were a customer around November 2023, check the Enova/CashNetUSA data-breach settlement status. Lawhelp.org can help locate free assistance.
Where should I file a complaint?
CFPB, FTC, and your state attorney general or financial regulator. California, Pennsylvania, and Washington have taken state-level action related to CashNetUSA or similar online lenders in the past.
The Bottom Line
If you are still current and have been offered an extension, read the deceptive-extension section carefully before sending any money. If payments are becoming impossible, request an Extended Payment Plan in writing at least two business days before the due date and keep the confirmation. Once the account defaults, revoke ACH authorization, validate every collector that contacts you, and treat any court paper from UHG I LLC as a real lawsuit that requires a response. If you received a 2023 security notice, check whether you remain eligible for the data-breach settlement.
